The police on Wednesday [Aug 29]
arraigned three persons: Andrew Adeyan, 20, Tosin
Samuel, 22 and Ibrahim Azeez, 23
before an Ikeja Magistrate’s Court, Lagos, for allegedly gang-raping a
21-year-old lady.
It was alleged that the three
accused persons raped the victim, Moyidyat
Kamorudeen, while she was returning from work at night. The police said the
incident happened at about 8:45pm on August 21 at the Ketu area of the
metropolis.
They were charged with two counts of
conspiracy to commit felony and rape.
The charge sheet read:
“That you
Adeyan, Samuel and Azeez and others now at large within the Ikeja Magisterial
District did conspire together to commit felony”.
“That you
Adeyan, Samuel and Azeez did forcefully had carnal knowledge of Moyidyat Kamorudeen
without her consent”.
The offences were punishable under
sections 409 and 258 of the Criminal Law of Lagos State of Nigeria, 2011. When
their plea was taken, Samuel and Azeez pleaded not guilty to the two
charges.
However, Adeyan admitted to conspiring to commit the offence but pleaded not
guilty to raping the victim.
Counsel to Samuel and Azeez, Mr. F.A. Izegaegb, made an oral
application for their bail on liberal terms. But Police Prosecutor, Barth Nwaokonye, who did not object the
bail application, urged the court to grant it on stringent terms.
He said, “I urge the court to grant the
three defendants bail on stringent conditions so as to ensure that they present
themselves in court during tria”.
Magistrate E.O. Ogunkanmi admitted them to bail in the sum of N100, 000 with
two sureties each in like sum.
He added that the sureties who must
be blood relations should furnish the court with evidence of tax payment to the
state government as well as verifiable addresses.
The case has been adjourned till
October 8 for trial.
